The Techno Avenue Web site is created for the exclusive use of Techno Avenue customers for the purpose of providing basic information about products we sell. The content of this website or the email we sent out may not be duplicated, redistributed or modified in whole or part without prior written authorization from Techno Avenue. All policies, terms and conditions are subject to change without notice. If the General Terms and Conditions provided on our Web site do not answer your specific questions, or if you need more detailed information, please contact us by email or live chat.
Conditions of Sale and Payment Terms
To purchase any goods and/or services on our Site, you must be at least eighteen (18) years of age or the applicable state age of majority, be a natural person (no corporations, partnerships or other legal entities), and be a resident in the 50 states of the United States of America, exclusive of its commonwealths, territories and possessions ("United States"). Prior to the purchase of any goods or services on our Site, you must provide us with a valid credit card number and associated payment information including all of the following: your name as it appears on the card, your credit card number, the credit card type, the date of expiration and any activation numbers or codes needed to charge your card. By submitting that information to us, you hereby agree that you authorize us to charge your card at our convenience but within thirty (30) days of credit card authorization. All sales of products and services are final. All charges from those sales are nonrefundable.
Prices & Availability
Due to the popularity of the products listed on our site, prices and availability are subject to change without notice. We do our best to provide the most accurate, up-to-date information, but errors do occur and we reserve the right to make changes without notice. If a product you ordered is not in stock, you will receive an email notifying you of the status of your order. If a product is no longer available, your order will be cancelled. Techno Avenue is unable to issue price adjustments due to manufacturer price changes after date of original sale.
Although we do our best to provide accurate information, occasionally errors and inaccuracies do occur. Should you encounter an error or inaccuracy on our site, please inform us so it can be corrected. Products and packaging depicted may differ from stock available at the time of shipment. We reserve the right to substitute equivalent items. If an error is made and a product is listed at an erroneous price, Techno Avenue may, at its discretion, refuse or cancel any orders placed at the incorrect price. If an order has been confirmed and charged to your credit card at the incorrect price, Techno Avenue shall have the right to immediately issue a credit in the amount of the incorrect price.
Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Techno Avenue reserves the right at any time after receipt of your order to accept or decline your order for any reason. Techno AVenue further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by Techno Avenue upon shipment of products or performance of services that you have ordered, or upon the completion of the license and delivery of a Digital Download, as indicated by our servers. Title to goods and all risk of loss passes to you upon delivery to the common carrier. All orders must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order. Techno Avenue is a reseller to end users and does not accept orders from resellers, exporters, wholesalers, any businesses of any kind or other customers who intend to resell.
Methods of Payment
Credit Card Terms and Taxes. All payments must be made by VISA, MasterCard, American Express or Discover Card (each of which may be removed by Techno Avenue in its sole discretion). Unless expressly set forth on the Techno Avenue website, we do not accept any other payment form. If we offer or accept any other form of payment, you hereby agree to all restrictions, terms and conditions associated with such additional form of payment. Your card issuer agreement governs your use of your designated card, and you must refer to that agreement and not this Terms of Use to determine your rights and liabilities as a cardholder. YOU, AND NOT TECHNO AVENUE, ARE RESPONSIBLE FOR PAYING ANY UNAUTHORIZED AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify Techno Avenue of any discrepancies within sixty (60) days after they first appear on your credit card statement, you agree that they will be deemed accepted by you for all purposes. If Techno Avenue does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Techno Avenue or its agents. You are responsible for paying any governmental taxes imposed on your purchases, including, but not limited to, sales, use or value-added taxes. Techno Avenue shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within California and Massachusetts and any other states or localities that it deems is required.
Applicable Taxes
Any sales, use or other applicable tax is based on the location to which the order is shipped. If you believe your purchases are not subject to sales tax, please contact sales@technoavenue.com prior to ordering for confirmation.
Warranty Disclaimer and Limitations on Liability:
Techno Avenue passes through to its customers all manufacturer warrantees and guarantees that are provided for the product we sell. Techno Avenue makes no additional or independent warranties.
To the full extent permissible by applicable law, Techno Avenue disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Techno Avenue shall under no circumstances be liable for special, incidental, consequential (including lost profits or opportunities), or punitive damages, even if it has been advised of the possibility of such damages. The maximum liability of Techno Avenue for all damages shall be limited to an amount not to exceed the purchase price of the product. Techno Avenue is not responsible for system downtime, lost date, etc.
Disputes
Any claims against Techno Avenue relating in any way to your purchases from Techno Avenue shall be submitted to confidential arbitration in Los Angeles, California. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. In any such arbitration, the parties shall be responsible for their own costs, expenses, and attorney's fees. In the event that this arbitration provision is unenforceable, any litigation regarding this agreement or any transaction between the customer and Techno Avenue shall be brought in the state or federal courts located in Los Angeles County, California, and the customer hereby agrees and submits to such jurisdiction and venue as exclusive and proper.
Governing Law:
Transactions between you and Techno Avenue, and any disputes arising between you and Techno Avenue related to any interaction between you and Techno Avenue, including but not limited to claims relating to the content of its catalogs and website, shall be governed by and construed in accordance with the laws of the State of California without regard to the laws regarding conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
This agreement, the policies printed on the Techno Avenue Web site, and the policies, terms and conditions stated on the applicable Techno Avenue invoice or packing slip, constitute the entire agreement between the parties relating to the subject matter herein, and cannot be modified except in a written agreement signed by both parties.
Jurisdiction
Unless otherwise specified, this Web site is presented solely for the purpose of promoting products available in the United States, its territories, possessions, and protectorates. This site is controlled and operated by Techno Avenue from its offices within the State of California, United States of America. Those who choose to access this site from other locations do so on their own initiative, and are responsible for compliance with laws governing export of software and other applicable laws, including local laws, if and to the extent local laws are applicable.
Title Risk of Loss:
Title to items being purchased passes from Techno Avenue to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. Techno Avenue will not incur any forwarding costs on shipments. Techno Avenue shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo, or other acts or events nothing within the reasonable control of Techno Avenue.

Techno Avenue, technoavenue.com and their respective logos are registered trademarks of Techno Avenue. and all other distinctive site logos, marks and graphic elements on the Techno Avenue website are trademarks of Techno Avenue and are subject to applicable trademark protections. All other company, product, and service logos, marks and names in Techno Avenue print and online advertising are or may be trademarks or service marks of the companies and organizations mentioned.
